USFS Proposal Spells Progress for Mining Advocates

The U.S. Forest Service (USFS) published an Advance Notice of Proposed Rulemaking (ANPR) in the Federal Register on September 13, 2018. The ANPR seeks comments on whether the USFS should revise 36 CFR 228A surface management regulations for locatable mineral operations pursuant to the U.S. Mining Laws and the USFS Organic Act.

Among the proposals is a revision the American Exploration & Mining Association (AEMA) has been pursuing for almost 18 years – that the USFS adopt an expedited procedure for exploration disturbing five acres or less, similar to the Bureau of Land Management’s (BLM) notice level operations in BLM’s 43 CFR 3809 regulations. One of the purposes of these revisions is to harmonize the Forest Service’s regulations with BLM’s in order to bring consistency to the regulations, regardless of which agency is managing the land.
